Terms of Use – SleepGrids

By accessing or using the SleepGrids mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1. Agreement to Terms

SleepGrids is owned and operated by SleepGrids ("we," "us," or "our"). These Terms constitute a legally binding agreement between you and SleepGrids.

2. Description of Service

SleepGrids is a sleep and habit tracking application that allows users to:

Log sleep quality and duration
Track daily habits
Visualize patterns through heatmaps and charts
Access analytics and insights (some features require Premium subscription)
Sync data across devices via iCloud
Export data in CSV or PDF format (Premium feature)
Share progress cards on social media

3. Eligibility

You must be at least 13 years old to use this App. If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the App.

4. User Accounts and iCloud

4.1 iCloud Sync

The App uses Apple iCloud services to sync your data across your devices. By using the sync features, you agree to Apple's iCloud Terms and Conditions.

4.2 Account Security

You are responsible for maintaining the security of your Apple ID and iCloud account. We are not liable for any unauthorized access to your data through your iCloud account.

5. Subscription Terms

SleepGrids offers optional Premium subscriptions. Pricing is displayed in the App Store in your local currency. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscription in your Apple ID Account Settings after purchase.

6. Acceptable Use

You agree not to use the App for illegal purposes, attempt to reverse engineer the App, or transmit malicious code. You are responsible for the accuracy of your data. Sleep tracking via mobile devices involves estimations; we do not guarantee 100% accuracy of sleep stages.

7. Intellectual Property Rights

We grant you a limited, non-exclusive, revocable license to use the App for personal use. You retain ownership of your logged data ("User Content"), but grant us a license to process it to provide the service.

8. Medical Disclaimer

IMPORTANT: SleepGrids is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Insights are based on statistical correlations, not medical causation.
The App is not a substitute for professional medical advice.
If you have a sleep disorder or chronic health condition, consult a doctor.
In an emergency, call emergency services immediately.

9. Third-Party Services

The App integrates with Apple services including iCloud and StoreKit. Your use of these services is governed by Apple's terms and conditions.

10. Data Export and Portability

Premium subscribers can export data in CSV or PDF format. You can delete all your data permanently through the App's settings at any time.

11. Limitation of Liability

To the maximum extent permitted by law, SleepGrids shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the last 12 months or $100, whichever is less.

12. Indemnification

You agree to indemnify SleepGrids from any claims or losses arising from your misuse of the App or violation of these Terms.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY OF DATA.

14. Termination

We reserve the right to suspend or terminate your access at any time for violation of these Terms or fraudulent activity.

15. Changes to Terms

We may modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the new Terms.

16. Changes to the App and Automatic Updates

The App may automatically download and install updates from time to time to improve performance or fix bugs. By using the App, you agree to receive such updates. We reserve the right to modify or discontinue any feature of the App at any time.

17. Apple-Specific Terms

You acknowledge that these Terms are between you and SleepGrids only, and not with Apple Inc. SleepGrids is solely responsible for the App and its content. Apple has no obligation to furnish any maintenance and support services for the App. SleepGrids, not Apple, is responsible for addressing any product claims or third-party intellectual property infringement claims. You agree that Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

18. Privacy

Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference.

19. Geographic Restrictions

The App is intended for use where available through the Apple App Store. We make no representation that the App is appropriate for use in all locations.

20. Dispute Resolution

These Terms are governed by the laws of Hong Kong. Any disputes shall be resolved in the courts of Hong Kong on an individual basis (Class Action Waiver).

21. Export Compliance

You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country.
